These Terms of Service ("Terms") govern your use of the Speaker & Mic Test application ("the App") published by Bulpara Inc ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Service Description

Speaker & Mic Test is an iOS application that runs guided pass/fail tests on iPhone speakers, microphones, stereo balance, and connected audio peripherals, and uses sonic frequencies to help eject water and dust from speaker grilles. Tests run on your device using AVFoundation. Features include a Full Audio Check, individual Speaker / Mic / Stereo Balance / Cleaning / Decibel Meter / Frequency Lab modes, and a saved Audio Health Report history.

2. Important Limitations

Speaker & Mic Test is a measurement and cleaning utility, not a guaranteed diagnostic or repair service. You understand and agree that:

• Test verdicts ("Pass", "Needs attention", "Fail") reflect whether components respond as expected during the test, not a certified hardware diagnostic. Apple Support or an authorized repair provider is the authoritative source for hardware diagnosis.
• The water and dust eject features use sonic vibration to dislodge particles. They cannot remove deeply embedded debris, repair physical damage, or guarantee that a clogged speaker will be restored to original performance.
• Results depend on your device, the audio route active during the test (built-in speaker, AirPods, Bluetooth, wired), and environmental noise. Run tests in a quiet room for best results.
• The Frequency Lab is intended for audio enthusiasts and informational use. Prolonged playback of high-amplitude tones can damage speakers and hearing — use with care and at a safe volume.
• The App is not a replacement for professional audio engineering or hardware repair.

3. Acceptable Use

You agree to use the App only for lawful purposes. You agree not to:

• Use the App to harass others with loud or high-frequency tones, or to play tones at volumes that risk damaging others' hearing
• Misrepresent an Audio Health Report as a certified hardware diagnostic in legal, warranty, or insurance contexts where one is required
• Reverse engineer, decompile, or extract bundled assets
• Attempt to circumvent subscription restrictions or free-tier limitations
• Use the App in any manner that violates applicable laws or third-party rights

4. Subscriptions & Billing

• Free tier: No charge. 3 audio tests per day, 1 cleaning session per day capped at 30 seconds, last 5 Audio Health Reports kept in history, always-free Decibel Meter and Frequency Lab demo, with banner and interstitial advertising.
• Premium Monthly: $4.99/month. Unlimited tests and cleaning, AirPods / Bluetooth / wired headphone testing, unlimited report history, PDF export, full Frequency Lab, and zero ads.
• Premium Annual: $9.99/year (save 83% vs. monthly), with a 7-day free trial. Same Premium feature set as monthly.
• Subscriptions are billed through the Apple App Store and are subject to Apple's Terms of Service.
• Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• If you cancel during a free trial period before the trial ends, you will not be charged.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers retain their original price for the remainder of the active term.

5. User Content

Audio Health Reports, cleaning session history, and preferences are stored locally on your device. You retain all rights to your test data. We do not access, collect, or store your test results on any server.

6. Intellectual Property

The App, including its design, code, and packaged content, is owned by Bulpara Inc and is protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for its intended purpose.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT TEST RESULTS OR CLEANING OUTCOMES WILL MEET YOUR EXPECTATIONS FOR A SPECIFIC DEVICE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULPARA INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Decisions made based on an Audio Health Report (warranty claims, repair decisions, device purchases)
• Hearing damage or speaker damage from playing tones at high volume
• Speaker hardware damage from extended cleaning sessions or improper use
• Subscription-related charges that fall under Apple's billing policy

9. Indemnification

You agree to indemnify and hold harmless Bulpara Inc from any claims, damages, or expenses arising from your use of the App, including any decisions you make based on test results.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.
